Bribery to a local or foreign public official:
This crime is committed by anyone who offers, consents to offer or deliver an economic benefit to a public official for her benefit or for a third party, in order to carry out actions or omissions that infringe the public duty of her position.
Money Laundering:
This crime is committed by anyone who hides or conceals the illicit origin of certain assets, knowing that they come from the perpetration of acts constituting crimes.
Receiving:
This crime is committed by those who, knowing its origin or having the ability to know this origin, have in their possession, transport, buy, sell, transform, or commercialize goods that come from theft, robbery, reception, misappropriation and/or theft of animals. In addition, the crime of reception punishes the negligent conduct of those who acquire or possess those assets.
Financing Terrorism:
This crime is committed by any person who, by any means, requests, collects, or provides funding for the purpose of committing terrorist activities.
Incompatible negotiation:
In this criminal offence, a public official uses his or her position for personal benefit and advantage, or that of persons related to him or her by any of the ties provided for by law, by benefiting or favoring them with business in which he/she must intervene in his/her capacity as a public official. It must be committed with malice aforethought and with intent to profit. It is consummated by its mere execution, without the need for a profit or a fiscal loss.
Corruption between private individuals:
Or private-to-private bribery, is an act of corruption whereby persons who are not public officials agree to perform acts that are outside the fiduciary duty of the bribed person, who agrees to do so in exchange for a financial benefit. This new criminal offence is punishable in the following two cases. a) When an Officer, Administrator or Chief Executive of a company requests or accepts an economic benefit for favoring or having favored, in breach of his or her duties, anyone who enters in a contract for goods or services in exchange for a bribe; the penalty shall be 541 days to 5 years in prison time and a fine of four times the value of the benefit. b) When the person who intends to enter into a contract offers or consents to give a financial benefit to an official, administrator or chief executive of the company, in order to obtain the closing of the contract; the penalty is the same that in the previous case.
Misappropriation:
This offence is committed by anyone who, to the detriment of another, appropriates or misappropriates money; effects; any other moveable goods that they have received in deposit, commission, or administration; or any other security that generates an obligation to deliver or repay.
Unfair administration:
This offence is committed by anyone who is entrusted with the safeguarding or managing other person’s assets or a portion of them -under the law, an authority´s decision or a contract- causes financial damage to he or she either by abusively exercising powers to dispose of his or her assets, forcing he or she, carrying out or omitting to carry out any other action in a manner manifestly contrary to his or her financial interests.
Fraudulently obtaining unemployment insurance:
Under the current law, people who obtain through simulation or deceit unemployment benefits and who, similarly, obtain a monetary benefits greater than that to which they are entitled, shall be punished with minor imprisonment between its medium and maximum degree. The same sanction shall apply to those who facilitate the means to carry out such offences. The foregoing is without prejudice to the obligation to return the sums unduly received, including an inflation indexation adjustment.
Failure to comply with quarantine or imposed sanitary measures:
People who endangers public health by infringing the health or hygiene rules, duly published by the authority, in times of catastrophe, epidemic or contagion.
